Jury finds Rolling Stone Magazine and Author liable for defaming UVA dean.

The jury in the case involving a UVA dean’s defamation lawsuit has returned a verdict finding  Rolling Stone Magazine and the author of its debunked gang rape article liable for defamation.

As I opined previously, despite the high bar that was set by the trial court when it deemed that the dean was a public figure, the errors committed by Rolling Stone and the author in accepting at face value Jackie’s story created a very significant possibility that this jury would find that they acted with with a reckless disregard for the truth.

Given the problems presented by this case for Rolling Stone I have a degree of difficulty in understanding why they did not settle this case.  Sometimes, rather than fight a case when when you have extremely bad facts, it is better to acknowledge the wrongfulness of your conduct, make amends, and move forward.
